PRODUCT INFORMATION
Prices of goods and delivery displayed on the Curtis Stone website are current at the time of display. These prices are subject to variation without notice.
We will always attempt to be as accurate as possible with our product descriptions and pricing. However, we are unable to warrant that product descriptions or other content of the website is accurate, complete, reliable, current or error free.
ORDER AND PAYMENT
We take payment at the time of order, not necessarily the time of dispatch. This is to ensure there are no last minute hitches to getting your gift delivered on time.
No order is accepted by Food Fight until the order has been checked and approved. You will be contacted within 3 days if a problem exists.
Food Fight is not responsible for any loss or damage caused by late delivery or cancellation of an order or a product.
We reserve the right not to provide goods or services, terminate membership accounts, remove or edit content or cancel orders at our sole discretion at any time.
If you need to cancel an order, please contact us immediately on 516-754-2828. Our agreement with you only comes into existence once we have both confirmed your order and your payment has been processed. Once we have accepted payment for an order, cancellation of the order is within our sole discretion. Orders that cannot be cancelled will be subject to our terms, conditions and policies relating to

TAXES
United States of America
Taxes will apply only to deliveries in California. Deliveries outside of California are tax exempt.
Deliveries to California will incur a state sales and county tax of 7.75%.
Australia
All orders will be subject to GST (currently 10%)
SECURITY
The Curtis Stone website uses SecurePay's Internet Payment Gateway to provide a secure environment for the authorization of credit card transactions over the Internet. Confidential information including client credit card details are encrypted the moment they are transmitted from the client's browser to the banking network using industry standard SSL 128-bit RC4 encryption technology.
A client's credit card details are not stored anywhere on the Internet and the only company who has access to this data is the merchant's bank. The bank also sends confirmation information via the same encryption technology back to the client's browser. These secure processes provide clients with peace of mind when purchasing online.
DELIVERY
The goods will be delivered to the Delivery Address and we will make every effort to deliver in a timely manner. However, while we make every effort to deliver on time, all delivery dates specified are estimates only.
Anyone at the Delivery Address who receives the goods shall be presumed to be authorized to receive the goods.
It is your obligation to enter the correct delivery address details at the time of ordering. Should you enter the wrong address, we are not obliged to re-send the order to the correct address at our expense.
It is the responsibility of the customer to inform Food Fight if an order does not arrive. Once we learn an order has not arrived, we will lodge enquiries with the courier to ensure delivery occurs as soon as possible. We will not be held liable for any loss or damage resulting from late delivery.
You agree that when our courier partner is satisfied that the order has been delivered; delivery of the order has taken place within the terms of the agreement between you and us.
Without limiting the operation of any other Terms and Conditions herein, we will not accept liability for any loss or damage arising from a late delivery.
Without limiting the operation of any other Terms and Conditions herein, you agree that late delivery does not constitute a failure of our agreement, and does not entitle you to cancellation of an order. Without limiting the operation of any other Terms and Conditions herein, we will not accept liability for any loss or damage arising from items lost, stolen or damaged after delivery has taken place.
RETURNS OR REFUNDS
If at any time you are not satisfied with the quality of the goods you have purchased, you may contact our Curtis Stone Customer Service Centre and a representative will assess your request for a credit or refund of the purchase price.
In the event that you receive a defective or damaged product, we will refund the original product price and deliver via the original method of payment. Alternatively, if you request a replacement, we will dispatch your replacement item (subject to availability) once we receive the return, at our cost.
Please allow up to 14 days for refunds to be processed upon our receipt of goods.
OUT OF STOCK
In the unlikely event that we cannot satisfy your order due to stock unavailability, we will contact you to provide an expected delivery date, offer an alternative product, or provide a refund.
GIFT VOUCHERS
Gift Vouchers cannot be redeemed for cash. No cash change will be provided.
The Curtis Stone website and Food Fight Ltd do not accept responsibility for vouchers lost, damaged or stolen, or any unauthorized use of vouchers.
Gift Vouchers cannot be used in conjunction with any promotional or discount offers. Acceptance of a gift voucher constitutes acceptance of these terms and conditions, which may change at any time.
Voucher will expire 12 months from purchase date.
DISCLAIMER
The information contained on the website is provided by Food Fight in good faith. To the best of our knowledge, the information is accurate and current. However, Food Fight does not make any representation or warranty as to the accuracy or completeness of the information.
You further acknowledge and agree that Food Fight will not be liable to you or any other person for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to damages for product liability, personal injury or negligence resulting from use of goods or services supplied to you, or on behalf of you, through the website.
RELEASE & INDEMNITY
You agree to waive any and all claims that you now have or may have in the future against Food Fight Ltd which relate to or are incidental to any transaction.
You agree to indemnify and hold Food Fight Ltd harmless from and against any and all claims, loss or expense that may be incurred by Food Fight Ltd which relate to or are incidental to the performance of its duties as described in these Terms and Conditions including all costs of defending itself against a claim by any other person and/or as a result of you taking any action or refraining from taking any action or instituting or defending any action or legal proceeding.
You further agree to indemnify and hold Food Fight Ltd harmless from any claim made by any third party due to or arising out of your use of this website, the violation of these Terms and Conditions by you, or the infringement by you, or other users of this website using your membership account, of any intellectual property or other right of any person or entity.

Transactions processed on the Curtis Stone website will appear as Food Fight on your credit card statement.
